BANGKOK, 5 February 2014 The Constitition Court has rejected a request for judgement whether the anti-government People’s Democratic Reform Committee (PDRC) violates Section 68 of the charter, saying the group has the constitutionsl right to rally.
The court’s decision on Wednesday came after Singthong Buachum asked it to take legal actions against protests by the PDRC and the People and Student Network for the Reform of Thailand. Mr Singthong alleged that the two groups acted to gain unconstitutional power to rule the nation by occupying government builings, blocking roads and disrupted the general election even in the areas where the Emergency Decree was enforced.
The charter court’s justices agreed that the protests were not against the constitution but suggested other legal bodies consider whether the two groups broke the Criminal Code or other laws.
The court also unanimously agreed to turn down the Democrat party’s request for a decision against the invocation of the Emergency Decree by the caretaker government
